“Should I consider an Enterprise Agreement (EA) for my business?”

With the introduction of Modern Awards in 2010 and the transitional arrangements involved for businesses, we can become hindered by the effect that this type of change has on the operational side of our business. Many of our clients have been faced with either ending one of their services due to the financial impact, or, to look at how they could support their business operations by implementing an Enterprise Agreement.

Often business owners think that they need to have a ‘large’ business to justify an Enterprise Agreement. This is simply not the case. Your business could benefit from an Enterprise Agreement if:

1. Your business is at risk of not complying with transitional arrangements.

2. Your employees are covered by multiple awards.

3. You are concerned about the sustainability of your business operations due to award provisions and/or you would like to modify your operations but the awards do not seem to support it.

4. There is uncertainty in tendering for projects because of too many variables in labour costs.

5. There is difficulty in attracting and retaining staff, particularly in competition with mining.
